Terms of Service Agreement

 

Welcome to The Boxify!

By using our storage, home-to-home delivery services, you agree to be bound by the following terms and conditions. Please read this document carefully before you proceed.

1. Definitions

  • "Client," "You," or "Your" refers to the individual or entity who uses our services.
  • "Company," "We," "Us," or "Our" refers to The Boxify, the storage, home-to-home delivery service provider.
  • "Goods" refers to the items, possessions, and property you entrust to us for delivery.
  • "Services" refers to our home-to-home delivery service for your Goods.
  • "User Fees" refers to the amounts you pay for our Services, as specified in your invoice.

2. General Use and Financial Terms

a. Service Agreement

You agree to use our Services and pay all associated User Fees and taxes as outlined in your invoice.

b. User Fees and Payment

  • Storage and Delivery Payments: All User Fees are due in advance on the first day of each storage cycle. We reserve the right to increase User Fees from time to time with at least 30 days' prior written notice.
  • Late Fees: If you pick up your storage late, we will auto extend your storage fee. If a payment is not received within 3 days of the due date, a late fee of the greater of 5% of the User Fees or $5.00 will be charged and will accrue every 6 days thereafter.
  • Returned Payments: If a preauthorized debit or other payment is not honored by your bank, an NSF fee of $35.00 will be charged. We may, at our discretion, cease to accept preauthorized or check payments from you.

3. Use of Services

a. Preparation of Goods

You are responsible for properly packing and securing all Goods for delivery. We are not liable for damage to items that are not adequately packed.

b. Prohibited Items

You shall not request delivery of the following items:

  • Food of any kind, perishable items, or any materials that could attract pests.
  • Flammable, hazardous, toxic, or explosive materials.
  • Firearms or ammunition.
  • Any items that would result in the violation of any federal, provincial, or municipal law.
  • Illegal Use: You shall not use our Services for any illegal or criminal purposes. We reserve the right to refuse service for any item we deem unsafe or in violation of this agreement.

c. Values of goods

  • The total value of each order's storage goods shall not exceed CAD $10,000.

d. Access

You are responsible for ensuring clear and safe access to the pickup and delivery locations.

4. Waiver of Liability and Indemnity

  • Disclaimer: We are not responsible or liable for any loss, damage, or injury to any property or persons arising from your use of our Services. This includes, but is not limited to, damage from fire, theft, vandalism, water, or mechanical failure, even if caused by our negligence or the negligence of a third party.
  • Client Responsibility: You agree to indemnify, defend, and hold harmless the Company from any and all claims, costs, and expenses (including legal fees) arising from any act, omission, or negligence on your part or by any of your agents or invitees.
  • Assumption of Risk: You acknowledge and agree that you use our Services at your own risk.

5. Termination

  • Client Termination: You may terminate our service at any time by providing written notice.

  • Company Termination: We may terminate this agreement upon 48 hours' prior written notice to you. We may also, without termination of the agreement, refuse service in the event of your default on any terms of this agreement, without any abatement of your User Fees.

6. Default and Lien

  • Late Payment: If payment is not received within 30 days of the due date, we may hold your Goods and consider them abandoned.
  • Sale of Goods: After 90 days of non-payment, we reserve the right to sell or dispose of your Goods to recover all outstanding User Fees and associated costs. You waive and renounce any legal benefit that would limit our right to seize and sell your Goods for non-payment.
  • Lien: This agreement confers on the Company a lien pursuant to the applicable possessory or warehouse lien legislation in the province where the Goods are being stored.

7. Other Terms

  • Change of Information: You must notify us in writing immediately of any changes to your address, phone number, payment information, or other personal details.
  • Privacy: Our Customer Privacy Policy, available on our website, applies to this agreement. By using our Services, you consent to our collection and use of your personal information as described in that policy.
  • Governing Law: This agreement will be governed by and construed in accordance with the laws of the province where our business is located.

By electronically or physically accepting this agreement, you confirm that you have read, understand, and agree to be bound by all of its terms and conditions.
